1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Amplifier platform ("Service"), operated by Amplifier Consulting Limited ("Amplifier", "we", "us", "our"), a company registered in England and Wales under company number 17038769, with registered office at Office 2.05, Clockwise, Old Town Hall, 30 Tweedy Road, Bromley, BR1 3FE. ICO registration C1913003.

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.

If you do not agree to these Terms, do not use the Service.

2. Definitions

"Account" means your registered Amplifier account, including all associated data, connections, and settings.

"Channel" means an external communications platform connected to Amplifier (e.g. Gmail, Slack, WhatsApp, LinkedIn, Teams, Telegram, SMS).

"Content" means any messages, files, attachments, notes, or other material transmitted through, stored in, or generated by the Service.

"AI Features" means the artificial intelligence capabilities of the Service, including categorisation, summarisation, draft replies, writing style analysis, action item extraction, and suggested actions.

"Context Sources" means optional third-party integrations that provide additional data to the AI engine (e.g. Granola, Notion, Shopify, Stripe).

"BYOM" means Bring Your Own Model, the feature allowing eligible users to route AI processing through their own API keys.

"Organisation" means a group account under which multiple users access the Service.

"Free Trial" means the initial 30-day period during which you may use the Service at no charge.

3. Account Registration

To use the Service, you must create an account by providing a valid email address, your name, and valid payment card details. You must be at least 18 years old to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@weareamplifier.co.uk if you become aware of any unauthorised use.

You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false or outdated information.

4. Free Trial

New accounts receive a 30-day Free Trial beginning on the date of account creation. During the Free Trial, you have access to the features included in your selected plan tier.

You must provide valid payment card details at the time of registration. Your card will not be charged during the Free Trial unless you exceed any usage limits specified for your plan tier.

At the end of the Free Trial, your subscription will automatically convert to a paid subscription at the applicable rate for your selected plan tier. If you do not wish to continue, you must cancel before the Free Trial expires. Cancellation can be done through the Settings page in the Service.

We reserve the right to modify or discontinue the Free Trial at any time without notice.

5. The Service

5.1 Description

Amplifier is a unified communications inbox that aggregates messages from multiple Channels into a single interface. The Service uses AI to categorise, summarise, and draft replies to help you manage communications more efficiently.

5.2 Channel Connections

You may connect one or more Channels to your Account. Each connection requires authentication via OAuth, API key, or bot token, depending on the Channel. By connecting a Channel, you authorise Amplifier to access, read, and (where applicable) send messages through that Channel on your behalf.

You are responsible for ensuring that your use of Amplifier complies with the terms of service of each connected Channel. Amplifier is not liable for any action taken by a Channel provider in response to your use of the Service (e.g. rate limiting, account suspension, or API access revocation).

5.3 AI Features

AI Features are included in all plan tiers and are active by default for categorisation and summarisation. Advanced AI Features (auto-drafting, writing style analysis) require explicit opt-in.

AI-generated content (draft replies, summaries, suggested actions) is provided as a suggestion only. You are solely responsible for reviewing and approving any content before it is sent to a recipient. Amplifier does not send AI-generated messages without your explicit action.

AI outputs may be inaccurate, incomplete, or inappropriate. Amplifier makes no warranty as to the accuracy, quality, or suitability of AI-generated content.

5.4 Context Sources

You may optionally connect Context Sources to enrich the AI engine with additional data (e.g. meeting notes from Granola, pages from Notion, order data from Shopify). Each Context Source requires a separate connection and explicit consent. You may disconnect a Context Source at any time through the Settings page.

5.5 BYOM (Bring Your Own Model)

On eligible plan tiers (Team and above), you may configure BYOM to route AI processing through your own API keys. When BYOM is enabled, message content is sent to your specified endpoint. Amplifier has no control over how your chosen AI provider processes the data, and you accept full responsibility for your provider's data handling practices, terms of service, and compliance.

5.6 Third-Party Aggregators

Certain Channels (currently LinkedIn) are accessed via third-party messaging aggregators (currently Unipile). When you connect such a Channel, your data passes through the aggregator's infrastructure. You will be clearly informed of this before connecting, and a link to the aggregator's privacy policy will be provided. By connecting, you consent to the aggregator's involvement in the data flow.

6. Your Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

You are the Data Controller for all personal data processed through your Account. You are responsible for ensuring that you have a lawful basis to process the personal data of your contacts through Amplifier, and for responding to any data subject requests from those contacts.

7. Intellectual Property

7.1 Our IP

The Service, including its software, design, branding, documentation, and AI models (where Amplifier-managed), is owned by Amplifier Consulting Limited or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

7.2 Your Content

You retain all rights in the Content you submit to or process through the Service. By using the Service, you grant Amplifier a limited, non-exclusive, worldwide licence to process your Content solely for the purpose of providing the Service to you. This licence terminates when you delete the Content or close your Account (subject to our data retention periods).

We do not use your Content to train AI models. Amplifier-managed AI features use commercial API services (e.g. Anthropic, OpenAI) under their API terms, which prohibit training on customer data.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the Service, without obligation to you.

8. Privacy and Data Protection

Our collection and use of personal data is described in our Privacy Policy and Data Handling Policy, available at weareamplifier.ai/privacy. These documents form part of your agreement with us.

Where you use the Service as a Data Controller, and Amplifier processes personal data on your behalf, the Data Processing Agreement (DPA) available on request applies. The DPA sets out the obligations of both parties under UK GDPR and the Data Protection Act 2018.

We take security seriously. Our security measures are described in the Data Handling Policy. However, no system is perfectly secure, and we cannot guarantee the absolute security of your data.

9. Availability and Support

We aim to provide the Service with reasonable uptime but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

Support is provided via email at support@weareamplifier.co.uk. Response times vary by plan tier. Enterprise customers receive priority support as specified in their service agreement.

We may modify, update, or discontinue features of the Service at any time. Where a change materially reduces the functionality of a feature you rely on, we will provide at least 30 days' notice via email.

10. Suspension and Termination

10.1 By You

You may cancel your Account at any time through the Settings page or by emailing support@weareamplifier.co.uk. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

10.2 By Us

We may suspend or terminate your Account immediately if:

Where reasonably possible, we will provide notice before suspension or termination. On termination, your right to use the Service ceases immediately. We will retain your data for 90 days to allow export, after which it will be deleted in accordance with our Data Handling Policy.

10.3 Effect of Termination

Sections 7 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.

11. Limitation of Liability

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

You acknowledge that the Service aggregates data from third-party Channels and that Amplifier is not responsible for the availability, accuracy, or conduct of those third-party platforms.

You agree to indemnify, defend, and hold harmless Amplifier, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will provide at least 30 days' notice via email to the address associated with your Account and by posting the updated Terms on the Service.

Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and cancel your Account before the effective date.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. This does not affect any mandatory consumer protection rights in your country of residence that cannot be waived by contract.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally by contacting support@weareamplifier.co.uk. If the dispute is not resolved within 30 days, either party may proceed with formal legal action.

15. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, Data Handling Policy, User Consent Model, and Terms of Sale, constitute the entire agreement between you and Amplifier.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Force Majeure. Amplifier shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government action, or internet infrastructure failures.

Notices. Notices to you will be sent to the email address on your Account. Notices to us should be sent to legal@weareamplifier.co.uk.
